On 20 August 2018, “The Baseline of Trade Secrets Litigation in the EU” was published. It is a report coordinated by the European Observatory on Infringements of Intellectual Property Rights, hosted by the EUIPO, in collaboration with lawyers from all European jurisdictions.
The main purpose of this study is to compare the national regulations and jurisprudence of trade secrets in each member state, as well as to analize the different profiles of the parties and courts involved.
To this end, the report provides a detailed analysis of the 28 legal systems of the EU member states, taking into account the status quo and the potential problems, in terms of illegal acquisition, use or disclosure of trade secrets.
