The amended Implementing Regulation of the Spanish Law 17/2001

The Official State Gazette of 30 April 2019 has published the entry into force of the amended Implementing Regulation of the Spanish Law 17/2001, of 7 December, on Trademarks, which includes the necessary modifications after the entry into force on 14 January 2019 of the amended Spanish Law 17/2001, of 7 December, on Trademarks.

The most relevant changes introduced by the Regulation are the specification of the formal requirements concerning the proof of use in opposition proceedings, as well as the formal requirements for cancellation and declarations of invalidity proceedings before the Spanish Patent and Trademark Office (OEPM). However, it will not be possible to initiate cancellation and declarations of invalidity proceedings before the OEPM until 14 January 2023.

The amended Implementing Regulation will enter into force on 1 May 2019.
